Infrastructure for everyday life

The essentials are here.

Your home's connections become part of the building plan. Each property package states exactly what reaches that lot.

Electricity

Electricity is available within La Encantada through ICE, along the main road. Owners apply for service and arrange the connection to their lot and home.

Internet

Fibre internet is already available within the finca. Owners apply for service and arrange the fibre line to their lot and house.

Roads & access

About 7 km of shared internal roads, maintained through the Asociación de Propietarios Finca La Encantada. Owners arrange their private driveway and access to the home.

Wastewater

Each home's on-site wastewater system is planned as part of its design and construction.

Water at La Encantada

An established water system. A shared resource to care for.

La Encantada's water story has developed over time through local wells, technical studies and infrastructure reviewed by AyA. Today, ASADA Las Delicias manages the community water service, combining system maintenance and water-quality checks with modern digital meters that help monitor consumption and identify unusual usage patterns.

Water availability for your home

Water availability letters for all lots have been secured at the development level. Each buyer requests the issuance of their individual letter through ASADA's established application process.

Owners can request access to their meter's consumption reports, supporting early awareness of potential leaks and more thoughtful water use.

What you can build

One home, up to 300 m².

The most important number for planning a home at La Encantada is not a percentage. It is the limit on the home itself.

Three separate layers of rules set what can be built on a lot: Costa Rica's national subdivision rules (INVU), the Municipality of Nicoya's land use and environmental restrictions, and the registered ecological easement covenant. A more generous figure in one layer does not override a stricter one in another. The strictest applies. Regulations continue to evolve, so check the current requirements with your architect or builder when you are ready to submit your designs.

FigureWhat it meansWhat it does not mean
300 m² main homeOne principal single-family home of up to 300 m² total construction area on an agricultural parcelNot 300 m² per floor
10% residentialThe combined maximum for residential, agricultural-worker and related agritourism structuresNot extra homes beyond the one principal home
25% total coverageThe overall maximum for qualifying uses, including eligible agricultural facilitiesNot 25% residential buildability
15% covenant footprintThe ceiling on footprint set by the registered covenantNot an allowance; lower national or municipal limits still apply
5,000 m² minimum lotThe minimum parcel size for the agricultural routeVillage lots border a public road and carry their own uso de suelo; the INVU limits on the home still apply
How each lot is shared under the covenant
At most 15% built (a ceiling; national limits on the home still apply)Light agriculture, gardening or voluntary conservationAt least 40% protected
Example: a 5,000 m² parcel
  • 25% overall coverage: 1,250 m² theoretical ceiling for qualifying uses
  • 10% residential and related: 500 m² theoretical ceiling
  • The main home is still limited to 300 m² of total construction
  • The remaining 750 m² is not available for extra homes; any use must qualify and be approved
Guests and extra buildings
  • Guest bedroom or suite in the main house: may fit within the one home, subject to municipal review of the plans
  • Detached guest house: should be verified with the municipality by your architect
  • Agricultural-worker housing: not a route for family or tourist guests
  • Tourist lodging or agritourism: needs separate permission
  • Pools, garages, terraces, decks, storage: how they count is confirmed with the authority

These figures reflect our reading of the national rules as amended in 2026. Regulations continue to evolve, so for final confirmation check with your architect or builder. Before finalising building plans, obtain a lot-specific municipal land-use confirmation and an architectural feasibility review. This page is guidance, not a permit, legal opinion or guarantee of buildability.

Ecological easement

Living in harmony.

La Encantada is developed under an Ecological Easement Covenant registered in Costa Rica's Public Property Registry and monitored in perpetuity by CEDARENA. Every owner joins the Asociación de Propietarios Finca La Encantada, the owners' association. This is a plain-language summary; the registered text governs.

Village lots (968 to 1,500 m²) are registered under the same ecological easement (servidumbre ecológica), but because they border a public road, the municipality grants them a different land-use designation (uso de suelo) on request. How far their rules differ from lots inside the finca depends on the regulations at the time and on how municipal officials apply them, so confirm with your architect or builder.

Building
  • Footprint at most 15% of the lot, counting house, garages, pools, storage and farm buildings. This is a ceiling, not an allowance; national and municipal rules may set lower limits (see What you can build).
  • The covenant refers to up to two guesthouses, but national rules allow one dwelling per agricultural parcel. Whether a detached guest house is possible on your lot should be verified with the municipality by your architect.
  • At most two floors above ground.
  • Natural colours and materials; warm, low outdoor lighting for dark skies.
  • Construction from 6 am to 5 pm on weekdays and 6 am to noon on Saturdays; no work on Saturday afternoons or Sundays.
Nature
  • At least 40% of every lot protected. With at most 15% built, the remaining 45% is for light agriculture, gardening or voluntary conservation.
  • Lots may not be fenced, so wildlife can move freely.
  • No harmful pesticides.
  • No cattle, goats, sheep or pigs. Horses welcome as the land allows.
Use of the lot
  • Residential use, light agriculture and conservation.
  • No subdivision and no commercial use. Rentals allowed for a minimum of four weeks.
Community
  • Membership of the Asociación de Propietarios Finca La Encantada, which looks after roads, the reserve and shared guidelines.
  • Annual dues are set by the owners and shared in the property package.
